  • In alignment with our Commercial Refund Policy, all fees paid for tender documents, drawings, specifications, and bidding packets are strictly non-refundable under any circumstance.
  • Rationale: The delivery of digital tender files represents the irreversible disclosure of proprietary engineering drawings, intellectual property, and confidential Bill of Quantities (BQ) data.
  • All tenderers, bidders, and vendors are exclusively responsible for conducting their own independent physical site inspections, soil verifications, quantity take-offs, risk assessments, and logistical calculations prior to submitting any tender proposal.
  • Ansar Technologies makes no representation regarding the absolute completeness, arithmetic infallibility, or site exactitude of preliminary BQs or conceptual site plans provided within tender packs. The bidder assumes all commercial risk regarding its submitted bidding pricing.

4. DUAL FULFILLMENT MODALITIES DISCLAIMER: EASYPARCEL & OFFLINE COLLECTION

The physical dispatch, haulage, collection, and handover of engineering equipment, ICT hardware, cabling, and materials are administered under our Dual Fulfillment Model. Each modality carries specific operational boundaries:

4.1 Method 1: Online Shipping via EasyParcel Integration Disclaimer

While we strive to ensure prompt dispatch from our Seri Kembangan facilities, Ansar Technologies expressly disclaims all liability for delivery delays, missed delivery windows, transit diversions, or tracking synchronization latencies resulting from:

Standard shipping via EasyParcel covers goods only to the baseline liability limits established by the selected courier’s standard conditions of carriage. For fragile, precision, or high-value engineering instrumentation, the Buyer is solely responsible for requesting and financing supplemental marine or transit insurance coverage prior to dispatch.

  • Fulfillment through EasyParcel utilizes independent domestic courier and cargo providers (including Pos Laju, J&T Express / J&T Cargo, DHL eCommerce, Line Clear Express, Ninja Van, and commercial freight forwarders).
  • Ansar Technologies does NOT own, operate, or directly supervise these third-party courier fleets, vehicles, drivers, or sorting distribution hubs.
  • Severe tropical monsoons, flash floods, highway landslides, or impassable road conditions across Malaysia.
  • Festive holiday sorting congestion (e.g., Hari Raya Aidilfitri, Chinese New Year, Deepavali, Christmas peak parcel surges).
  • Courier vehicle mechanical breakdowns, labor strikes, terminal closures, or domestic freight flight cancellations.
  • Stated shipping timeframes (e.g., 3 to 7 business days for Peninsular Malaysia; 5 to 12 business days for East Malaysia) are reasonable logistical targets, not legally guaranteed arrival deadlines.
  • The Buyer is under an affirmative legal obligation to inspect external parcel packaging immediately upon delivery.
  • Failure to report external crushing, punctures, water ingress, or missing packages in writing within forty-eight (48) hours of courier delivery confirmation completely waives and extinguishes all rights to claim against Ansar Technologies for transit damage under Section 42 of the Malaysian Sale of Goods Act 1957.

4.2 Method 2: Offline Self-Collection (Mandatory Scheduled Pick-Up) Disclaimer

4.2.1 Post-Purchase Scheduling and Mandatory Attendance:

4.2.2 Representative Verification and Denial of Entry:

Ansar Technologies disclaims all liability for withholding items if a collecting driver, transport contractor, or agent fails to present a valid, stamped corporate Letter of Authorization, the official CHIP payment receipt, and original national identity documentation (NRIC/Passport).

Once the Buyer or its authorized agent signs the physical Delivery Order (DO) at our collection counter, legal title and all risk of loss, damage, theft, or cosmetic deterioration transfer unconditionally to the Buyer. Ansar Technologies disclaims all liability for missing components, exterior damage, or transit scratches discovered after the transport vehicle exits our depot gates.

  • Offline Self-Collection is not an open walk-in service. Following payment clearance via CHIP, our inventory division reviews yard operations and transmits a formal Collection Schedule Notice specifying the designated depot, date, and allocated time window.
  • The Buyer is under a strict contractual obligation to attend and execute collection at the date, time, and location officially designated.
  • Ansar Technologies disclaims liability for wasted journeys, lost transport hours, or transport demurrage incurred by the Buyer if the Buyer attends our premises without a confirmed Collection Schedule Notice or outside allocated operating hours.
  • Engineering depots, warehouses, and staging yards are active industrial environments with moving forklifts, heavy overhead hoists, high-voltage equipment, and crated materials.
  • Assumption of Risk: All visitors, drivers, and collecting personnel entering Ansar Technologies’ yards do so entirely at their own risk.
  • Ansar Technologies expressly disclaims liability for personal injury, accidental slips, vehicular impacts, property damage, or fatalities sustained on our premises resulting from:
  • Failure to wear mandatory Personal Protective Equipment (PPE) including safety boots, hard hats, and high-visibility vests.
  • Disregarding yard marshal instructions, designated pedestrian walkways, or speed restrictions.
  • Unassisted, improper manual lifting, or improper vehicle cargo loading.
  • Ansar Technologies is not responsible for determining whether the Buyer's transport vehicle (e.g., private car, open-bed lorry, trailer) is legally, mechanically, or structurally suitable for the cargo.
  • The safe strapping, blocking, lashing, covering, weight distribution, and road safety compliance of collected equipment remain the sole responsibility of the Buyer and its transport operator under the Malaysian Road Transport Act 1987.
  • Where the Buyer fails to attend the scheduled collection appointment, a Grace Period of fourteen (14) calendar days will be observed.
  • Following the expiration of 14 days, Ansar Technologies automatically assesses a daily Demurrage and Warehousing Fee of RM50.00 or 0.5% of invoice value per day (whichever is greater).
  • Abandonment Disclaimer: Any consignment left uncollected after thirty (30) calendar days from the scheduled collection date shall be deemed legally and irrevocably abandoned under the Contracts Act 1950. Ansar Technologies disclaims all continuing bailee liabilities, and retains the right to cancel the order, restock or liquidate the assets, and offset accumulated storage costs against any funds held.

5. ELECTRONIC PAYMENT GATEWAY AND FINANCIAL INFRASTRUCTURE DISCLAIMER (CHIP)

5.1 Third-Party Payment Architecture:

Online credit card, debit card, and FPX direct banking transactions conducted on our Platform are acquired, switched, tokenized, and cleared by CHIP (chip-in.asia), an independent licensed payment gateway operator subject to Bank Negara Malaysia regulations.

5.2 Non-Storage of Card Data:

Ansar Technologies complies with digital security frameworks and does NOT capture, view, store, or process full primary payment card numbers (PAN), CVV/CVC codes, or banking PINs on its own local servers. All payment data is tokenized via encrypted TLS pipelines directly into CHIP’s PCI-DSS compliant infrastructure.

5.3 Disclaimer of Banking and Gateway Interruptions:

Ansar Technologies expressly disclaims all legal and financial liability for:

  • Interruptions, systemic outages, drops, or timeouts originating within the FPX inter-bank network, card association networks (Visa, Mastercard), or CHIP’s clearing servers.
  • Unauthorized, delayed, or rejected transactions resulting from card issuer security holds, fraud triggers, or insufficient credit lines.
  • Inadvertent duplicate authorizations, overpayments, or browser refresh anomalies caused by client-side browser malfunctions or faulty internet connections.
  • Erroneous or duplicate payments will be handled in accordance with our Refund Policy, but Ansar Technologies disclaims liability for bank-assessed overdraft fees or third-party Merchant Discount Rate (MDR) processing deductions.

Payment Processing Gateway Disclaimer (CHIP)

  • Ansar Technologies does NOT store, view or retain payment card numbers or CVVs.
  • Gateway downtime, FPX timeouts and bank drops are third-party events.
  • Currency fluctuations and non-refundable MDR fees are buyer liabilities.
  • Disputed or errant payments must follow the formal compliance review route.

6. PRODUCT SPECIFICATIONS, HARDWARE ACCURACY, AND PERFORMANCE DISCLAIMER

  • Implied warranties of fitness for a particular bespoke engineering purpose (unless such purpose was explicitly guaranteed by Ansar Technologies under a signed, formal commercial agreement).
  • Non-infringement of third-party patent or intellectual property rights by foreign equipment manufacturers.
  • Incorrect electrical voltage input, neutral floating, electrical surge, or lack of proper earthing/grounding at the Client's installation site.
  • Lightning strikes, indirect surges, water immersion, chemical corrosion, or extreme environmental exposure.
  • Incompetent installation, improper cable bend radiuses, or unauthorized structural modifications executed by third-party contractors not authorized by Ansar Technologies.
  • Failure to perform periodic maintenance as stipulated in manufacturer service manuals.

7. CYBERSECURITY, SYSTEM AVAILABILITY, AND TECHNICAL INTEGRITY DISCLAIMER

7.1 "As Is" and "As Available" Platform Status:

This Platform, its digital databases, client portals, and downloadable content are provided strictly on an "AS IS" and "AS AVAILABLE" basis. Ansar Technologies does not warrant that:

The primary Client retains full legal and financial responsibility for statutory site approvals.

9.2 Compliance with the Construction Industry Payment and Adjudication Act (CIPAA):

All engineering contracting, progressive milestone claims, and construction disputes are governed by CIPAA 2012. Nothing stated on this Platform or in promotional literature modifies, derogates from, or waives the statutory rights and dispute mechanisms conferred upon contracting parties under CIPAA.

BHD., ITS DIRECTORS, SHAREHOLDERS, LICENSED ENGINEERS, PROJECT MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES FOR ANY AND ALL CLAIMS, DISPUTES, LOSSES, ACTIONS, PROCEEDINGS, OR LIABILITIES OF ANY NATURE—WHETHER GROUNDED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, RESTITUTION, STRICT LIABILITY, MISREPRESENTATION, OR COMMON LAW INDEMNITY—ARISING OUT OF OR DIRECTLY OR INDIRECTLY CONNECTED WITH:

SHALL BE STRICTLY AND ABSOLUTELY CAPPED AT AND LIMITED TO THE ACTUAL NET SUM PAID BY YOU TO ANSAR TECHNOLOGIES FOR THE SPECIFIC SERVICE COMPONENT, TENDER PACK, OR ITEM OF GOODS DIRECTLY GIVING RISE TO THE CLAIM, OR THE SUM OF RINGGIT MALAYSIA ONE THOUSAND (RM1,000.00), WHICHEVER IS LOWER.

11.2 Complete Waiver of Consequential and Special Damages:

Under no legal theory shall Ansar Technologies be held liable for any indirect, consequential, incidental, special, punitive, exemplary, or remote damages whatsoever, including without limitation: loss of anticipated profits, loss of business revenue, loss of goodwill, site idling expenses, plant hire demurrage, unearned procurement margins, loss of tender bids, loss of electrical utility feeds, or Liquidated Ascertained Damages (LAD) levied by main contractors, government employers, or third parties, even if Ansar Technologies was expressly advised of the possibility of such damages.

  • THE USE OF, BROWSING OF, OR INABILITY TO ACCESS THIS PLATFORM;
  • RELIANCE PLACED UPON INFORMATIONAL CONTENT, BLUEPRINTS, BQs, OR TECHNICAL DATA;
  • DELAYS, LOSSES, OR DEFECTS OCCURRING UNDER EASYPARCEL LOGISTICS TRANSIT;
  • LOGISTICAL DISRUPTIONS, STORAGE FEES, OR DEMURRAGE ARISING FROM OFFLINE SELF-COLLECTION;
  • FAILURES, TIME-OUTS, OR ERRORS OCCURRING ON THE CHIP PAYMENT GATEWAY;
  • THE PURCHASE, LOSS, OR DISQUALIFICATION OF TENDER DOCUMENTS; OR
  • THE PERFORMANCE, SUPPLY, OR DEFECT OF ANY ENGINEERING EQUIPMENT OR SERVICES;

Exclusion Of Indirect And Consequential Losses

  • Liquidated Ascertained Damages (LAD) imposed by a main contractor or client.
  • Loss of anticipated profit, commercial revenue, or business reputation.
  • Construction site downtime, crane standby costs, or plant rental fees.
  • Subcontractor demobilisation, remobilisation, or labour idle costs.
  • Data loss, data corruption, or cyber security breaches on client systems.

12. INDEMNIFICATION AND HOLD HARMLESS COVENANT

12.1 You unconditionally agree to defend, indemnify, protect, and hold entirely harmless ANSAR TECHNOLOGIES SDN. BHD., its parent corporate entities, subsidiaries, directors, officers, certified professional engineers, project managers, warehouse marshals, and legal counsel from and against any and all liabilities, third-party lawsuits, damages, judgments, fines, statutory penalties, costs, and expenses (including legal fees on a full solicitor-client indemnity basis) resulting from or arising out of:

  • Your access to, improper utilization of, or reliance on information displayed on the Platform.
  • Your violation of any clause, representation, or covenant contained in this Disclaimer, the Terms of Service, or incorporated commercial policies.
  • Any violation of the Occupational Safety and Health Act (OSHA) or hazardous conduct committed by your staff, haulers, or transport drivers during scheduled Offline Self-Collection at our operational depots.
  • Any unauthorized disclosure, reverse-engineering, or commercial reproduction of proprietary tender packages, BQs, or engineering designs obtained through our procurement portal.

13. SEVERABILITY, WAIVER, AND REVISIONS

13.1 Severability:

If any section, clause, sentence, or phrase in this Disclaimer is determined by a court of competent jurisdiction to be illegal, invalid, or legally unenforceable, such determination shall be severed and shall not affect, impair, or invalidate the remaining portions of this Disclaimer, which shall remain in full force and legal effect.

13.2 Non-Waiver:

No failure or delay by Ansar Technologies in enforcing any right, reservation, or legal defense set out in this Disclaimer shall operate as a waiver of that or any other right, nor shall any partial enforcement preclude further enforcement.

13.3 Unilateral Right of Revision:

Ansar Technologies reserves the unfettered right to amend, update, modify, or rewrite this Disclaimer at any time without prior individual notice. Revisions take immediate legal effect upon publication on the Platform, marked by the "Last Updated & Effective Date" legend at the top of this page. Your continued use of the Platform signifies acceptance of all revisions.

14. GOVERNING LAW AND EXCLUSIVE JURISDICTION

14.1 This Disclaimer, its construction, validity, enforceability, and all non-contractual claims or obligations arising from or connected to it shall be governed by, and construed exclusively in accordance with, the laws of Malaysia.

14.2 Exclusive Court Jurisdiction:

Any dispute, controversy, claim, or legal action arising out of or in connection with this Disclaimer, the Platform, delivery modalities, or payment gateway clearances that cannot be resolved amicably through senior corporate negotiation within fourteen (14) business days shall be submitted to the exclusive jurisdiction of the competent Courts of Malaysia, with legal proceedings initiated in the courts of Kuala Lumpur or the State of Selangor.

15. LANGUAGE AND STATUTORY PREVALENCE

This Disclaimer is drafted, finalized, and promulgated in the English language. In the event that this Disclaimer is translated into Bahasa Malaysia or any other language, and should any ambiguity, linguistic conflict, or divergence of meaning arise between the English version and any translated rendition, the English text shall govern, control, and prevail in all respects to the maximum extent permissible under Malaysian law.
